What are your Usage Policies?


Section I - Terms:

A. Service refers to Angelwire, a connection via phone lines to the Internet offered by BAK Enterprises.

B. User is the person who is signing this Agreement, who's name appears on the reverse side of this Agreement and accepts the Service.

C. Payment refers to the Setup Fee, the prorated amount due upon Service Activation, and the Quarterly or Yearly charges for use of the Service.

Section II - General Usage Agreements:

1. Usage Intents: Angelwire dialup accounts are intended for getting connected to the Internet only. Users may not run programs which provide network services from their accounts, including, but not limited to: IRC, MUD, WEB, or MAIL servers.

2. Resource Consumption: Angelwire users are prohibited from excessive consumption of resources, and the use of resource intensive programs which negatively impact other users or the performance of Angelwire systems or networks.

3. Data Transmission: Users are prohibited from transmitting, distributing, or storing any information, data, or material on or through any of Angelwire's services that are, in BAK Enterprises' sole discretion, unlawful, obscene, threatening, abusive, hateful, or encourages conduct that would constitute a criminal offense, give rise to civil liability, or otherwise violate any local, state, national, or international law.

4. User Access: Users may not attempt to circumvent user authentication or security of any host, network, or account. This includes, but is not limited to, accessing data not intended for the customer, logging into a server or account the user is not authorized to access, or probing the security of other networks.

5. Service Interference: Users may not attempt to interfere with any service to any other user, host, or network. This includes, but is not limited to, "flooding" of networks, deliberate attempts to overload a service, and attempts to "crash" a host.

6. User Liability: Users who violate systems or network security may incur criminal or civil liability. BAK Enterprises will fully cooperate with law enforcement authorities in the investigation of suspected criminal violations.

7. Sending E-mail: Users may not send e-mail to any person who does not what to receive it. If the recipient asks to stop receiving e-mail, the user must not send that person any further e-mail. Users are explicitly prohibited from sending unsolicited bulk mail messages, advertisements, informational announcements, etc.

8. E-mail Content: Sending e-mail with malicious content or modifying header information is strictly prohibited and in some states is criminal harassment.

9. Duplicate Logins: Duplicate logins are not allowed.

10. Newsgroups: BAK Enterprises provides an uncensored newsfeed. BAK Enterprises is not responsible for the content of any USENET posting, whether or not the posting was made by an Angelwire customer.

11. Chat Rooms: BAK Enterprises is not liable for the content of any communication made in any "chat room" using IRC, or any other similar chat room software.

Section III - General Policy Agreements:

1. Privacy, Transmission, and Capacity Limitations: User understands that, because the Internet is a largely a phone and computer based technology (1) data transmitted over the Internet may not be completely private, and (2) the Service is subject to transmission limitations caused by (A) phone line limitations and/or conditions, (B) modem limitations and/or conditions, or (C) computer limitations and/or conditions. In addition the service may be temporary limited or suspended due to system capacity limitations or system repairs or modifications. BAK Enterprises shall not be liable for malfunctioning or non-working computer hardware, software configurations, or Internet conditions whether it be the fault of the User nor not.

2. Cancellation Terms: User may cancel Service at any time. If User cancels within 7 days of the signup date, User will receive a full refund, including the setup fee. After 7 days of the signup date, and upon cancellation by the User, BAK Enterprises will refund any unused month that has been prepaid. Refunds will not be prorated, only completely unused months will be refunded. Users who have signed up on Yearly Billing Increments must pay an early termination fee of $15.00 if in the middle of a billing cycle. If a bill is due, and the User has not notified BAK Enterprises of cancellation, User is responsible for payment of current month. If the User is terminated by BAK Enterprises for any breach of this Agreement, the User is not entitled to any refund whatsoever. Refund checks will be issued by the second week of the following month. User may cancel by contacting BAK Enterprises by phone at 734.591.3925.

3. Non-Payment: Upon non-payment of any sum due to BAK Enterprises within 14 days of the due date on the invoice, or upon violation of the terms, conditions, or agreements for the use of this Service, BAK Enterprises may, by a notice in writing, in a phone call, or in an e-mail either refuse, reduce, or temporarily discontinue service to the User without incurring any liability. In addition, service may be refused, reduced, or temporarily or permanently discontinued without notice (without incurring any liability) if (1) BAK Enterprises has not received a payment for the amount due within 30 days of the due date on the invoice, or (2) if BAK Enterprises has learned that the User is or has been using the Service in a manner that violates this Agreement or any state or federal law. BAK Enterprises reserves the right to report the User to the proper credit authorities for failure of payment.

4. Reconnection Fees: User may be charged a reconnection fee to reinstate temporarily terminated or cancelled service.

5. Price/Feature Guarantee: BAK Enterprises does not guarantee that the cost of the Service will not increase, or that Internet taxes or other associated government fees will not arise. User understands that BAK Enterprises can raise the cost of the service or modify, delete, and/or add features with a 90-day written or e-mailed advance notice.

6. Long Distance Charges: Users outside of the Service's extensive selection of local access calling numbers may incur long distance charges that will be applied to their telephone bill. BAK Enterprises is not responsible for these or any calling charges of any nature in conjunction with or to our access numbers and/or Services.

7. Property Rights: User has no property rights to the username, e-mail address, or access numbers to the service, and none can be acquired by usage or otherwise. BAK Enterprises reserves the right to assign, designate, or change such numbers when deemed reasonably necessary in the conduct of it's business. Usernames and e-mail address of Users whose service is deactivated may be reassigned as soon as 5 minutes from the date and time of discontinuance.

8. Authorized Users: Customer may notify BAK Enterprises at any time of User's choice to designate other authorized users on their account. User gives BAK Enterprises permission to (1) provide account information to such authorized users to the extent that such information would be unavailable to the unauthorized user; and (2) make changes to the User's account as may be requested by such authorized users from time to time. User agrees to accept financial responsibility for all decisions and changes by such authorized users relating to the User's account. User may remove authorized users from the account at any time.

9. Right to Send E-mail: User expressly grants BAK Enterprises the right to contact User or notify User of System or Policy Updates by sending messages to User's e-mail account.

10. User Liability in Event of Fraud: Furnishing false data on the signup form, contract, or any application, including fraudulent use of credit card numbers, is grounds for immediate termination, and BAK Enterprises may subject the offender to civil or criminal liability, and will fully cooperate with law enforcement authorities in the investigation of suspected criminal violations.

11. Reselling the Service: The resale of the Service is not permitted, unless documented in a signed written agreement with BAK Enterprises.

12. Right to monitor Inbound Calls: User consents to BAK Enterprises monitoring and recording User's calls to BAK Enterprises in order to ensure quality.

13. Warranty of Service and Limitations of Liability: User understands that BAK Enterprises resells the Service and that when using the Service under this agreement, User is subject to the same limitations of liability that the operator of the Service imposes upon it's customers. BAK Enterprises does not warrant the service in any way, and will only compensate Users for outage and other periods of inactive Service at it's sole discretion.

14. Right to Modify this Agreement: BAK Enterprises reserves the right to modify any and all terms and conditions of this Agreement at any time with written notice to the User. Upon such notice, any changes shall automatically and without written amendment become part of this Agreement.

Breach of any term is grounds for immediate termination, all prepaid accounts are not subject for refund.
